Online store regulations and privacy policy
I. INFORMATION ABOUT THE ENTREPRENEUR
- These Regulations define the general conditions and rules of use of the online store located at: eyeminge.com , hereinafter referred to as the evaminge.com Online Store, by entities, including consumers, purchasing Goods via the evaminge.com Online Store.
- The evaminge.com online store, operating at eyeminge.com, is run by: Eva Minge Design Sp z o. o. based in Katowice, address: Al. W. Roździeńskiego 188c, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court Katowice-Wschód in Katowice, 8th Commercial Division of the National Court Register, under KRS number 0000428080.
Share capital: PLN 9,700,000.00 paid in full, REGON 242959643, NIP 9542738327
II. DEFINITIONS
- The phrases used in the Regulations mean:
- evaminge.com – Eva Minge Design Sp z o. o. based in Katowice, address: al. W. Roździeńskiego 188c 40-203 Katowice, entered into the Register of Entrepreneurs of the National Court Register under KRS number 0000428080. Share capital: PLN 9,700,000.00 paid in full, REGON 242959643, NIP 9542738327.
- Online Store - an organized IT platform for the presentation and sale of Goods run by EYE MINGE via the website eva minge.com .
- Customer – an entity, including a consumer, purchasing Goods via the Online Store.
- Goods – a product presented as intended for sale in the Online Store.
- Regulations – these Regulations.
- Order – an offer to purchase a specifically marked Good for the price shown in the Online Store, addressed by the Customer to EYE MINGE, in accordance with the Regulations.
- Customer Account - the Customer's personal data along with data on previous transactions and the status of the currently placed order, saved in the EYE MINGE IT system, access to which is protected by the login and password created by the Customer during registration.
III. GENERAL PROVISIONS
- evaminge.com, via the Online Store, presents marked Goods along with the unit price of each of them.
- Information about Goods intended for sale placed in the Online Store does not constitute an offer within the meaning of Art. 66§1 of the Civil Code, but a price list and an invitation for the Consumer to place an Order in accordance with the unit price of the Goods and the terms of the Regulations.
- The sale and delivery of Goods via the Online Store covers only the territory of the Republic of Poland.
- The condition for using the Online Store is to read and accept these Regulations.
- When receiving an Order, evaminge.com acts in the trust that:

- In order to properly use the Online Store, the user (Customer) should have computer hardware and software that meets the following minimum requirements:
IV. GOODS
- Each Good presented for sale via the Online Store contains an example photograph typical of its type and, in the appropriate tab, information about its properties, i.e. colors and materials from which it was made, specific product number.
- Each Good presented for sale in the Online Store is the property of evaminge.com, is brand new, free from physical and legal defects, and approved for trading in the Republic of Poland.
- The Goods presented in the photographs in the Online Store are examples of Products that are identical in type and are presented in a manner closest to their actual appearance. The photos reflect the colors and appearance of the Goods as accurately as possible. Due to individual settings or parameters of the user's monitor, there may be slight differences between the photo and the actual color of the Goods.
V. ACCEPTING AND PLACING ORDERS
- Orders in the Online Store can be placed 24 hours a day, 7 days a week only via the eyeminge.com website.
- Making a purchase in the Online Store does not require creating a Customer Account, but it is required to provide basic data enabling contact and shipment of the Goods.
- Placing an Order in the Online Store requires completing its individual stages. If the Customer wants to place an Order, he or she selects the type, model, color, size and quantity of the available Goods at the price indicated on the Website. The selection is made through dialog boxes on the Online Store website, in accordance with their functionality, including by clicking the "add to cart" icon. The customer also chooses the payment method. After selecting the Goods, providing the required data and payment method, the Customer sends the Order to evaminge.com by pressing "CONFIRM PURCHASE". Sending a correctly completed Order is tantamount to submitting to evaminge.com an offer to purchase the selected Goods in accordance with the evaminge.com price list and covering the costs of its delivery.
- After placing the Order, the Customer will receive feedback via e-mail to the address provided, including acceptance of the Order, indicating the quantity, type and value of the Order and a unique Order number. The e-mail received by the Customer is also a confirmation that the offer to purchase the Goods was submitted correctly, reached the evaminge.com Online Store and was accepted in accordance with the Regulations, and therefore a sales contract was concluded. Information about the acceptance of the offer by evaminge.com will include confirmation of the conclusion of the contract, including the name of the seller with his address, date of sale, description of the Goods' quantity, price and delivery costs.
- At each stage of placing an Order, until it is shipped, you can cancel it by interrupting the ordering process by removing previously added goods from the basket.
- A necessary condition for the execution of the sales contract via the Online Store is to provide the correct ordering entity, address for delivery of the Goods, telephone number and e-mail address. In the event of faulty data, the evaminge.com store reserves the right to contact the Customer.
- Price lists of Goods on the Online Store website are variable. The price of the Goods in accordance with the price list at the time of placing the Order by the Customer is binding for the Customer and evaminge.com.
- The maximum value of Goods covered by one Cash on Delivery Order cannot exceed PLN 3,000 (three thousand zlotys).
VI. GOODS PRICES AND DELIVERY COSTS
- The price of each Good presented in the Online Store is given in Polish zloty and includes VAT, but does not include delivery costs.
- Information on the total value of the order along with delivery costs is presented in the Cart after the Customer selects the payment method.
- Changes introduced in the prices of Goods in the Online Store will not affect the Order already placed by the Customer and accepted by evaminge.com.
- Promotions in the evaminge.com Store cannot be combined unless the regulations of a given promotion provide otherwise.
VII. PAYMENT METHODS
- The Online Store Customer may choose the following forms of payment for the ordered Goods:
- BY PAYMENT CARD (Visa. Visa Electron, Maestro, MasterCard, MasterCard Electronic) or ELECTRONIC TRANSFER. In such a situation, the Customer will be redirected to the BLUEMEDIA.pl website, owned by Blue Media SA based in Sopot at ul. Powstańców Warszawy 6, registered at the District Court Gdańsk-Północ in Gdańsk, 8th Commercial Division of the National Court Register under number 0000320590, with a share capital of PLN 2,000,000 (fully paid), NIP: 585-13-51-185; entered into the register of payment service providers under number IP17/2013, into the register of lending institutions under number RIP000109, into the register of credit intermediaries under number RPK002057, into the register of telecommunications undertakings under number 11050.
- Payment card via the First Data online payment system. The order is processed after the payment is authorized in the operator's system. Transaction security is ensured by PCI DSS, SSL and 3D Secure technologies.
- STANDARD TRANSFER: selecting this form of payment allows you to make the payment at any time, not exceeding 7 days from the date of placing the order. The order is processed after the payment is credited to the store's business account. After placing the order, you will receive an email with the bank account number to which the money should be transferred.
- PAYMENT ON COLLECTION: payment for the Goods is made upon receipt of the shipment - payment in cash is transferred to the courier upon receipt. This form of payment is only possible if you choose delivery by the DPD courier company.
- The Customer cannot combine different payment methods in one Order.
- The order will be placed incorrectly and the Sales Agreement will not be concluded in any case when:
VIII. ORDER COMPLETION TIME AND DELIVERY
- All accepted Orders are delivered to the Customer by the DPD courier company or the InPost SA postal operator
- For each Good, in accordance with the functionality of the Online Store, the maximum order processing time is provided by the Online Store, and the given time covers days from Monday to Friday. Order processing time varies depending on the selected payment method. The deadline for the execution of the Order begins:
- The time needed to process the order through the Online Store should include 1 day for delivery of the Goods.
- All customers will be informed by e-mail about the current status of the order. Additionally, customers who have a Customer Account can find order information in the MY ACCOUNT - Your orders tab on the eyeminge.com website.
- By default, the delivery address is the address provided by the Customer when registering in the store.
- If the Customer receives the Goods in damaged packaging, it is recommended to describe this fact when receiving the parcel from the courier and report it to an evaminge.com employee via e-mail to the following address: shop@evaminge.com
- In the event of unforeseen situations, evaminge.com will inform the Customer about the problem and how to solve it to the e-mail address provided in the Order.
IX COMPLAINT
- evaminge.com is liable for physical and legal defects of the Goods, in accordance with applicable regulations, including the Act of April 23, 1964. Civil Code (Journal of Laws of 2014, item 121) and the Act of May 30, 2014 on consumer rights (Journal of Laws of June 24, 2014, item 827).
- In particular, evaminge.com is liable for physical defects of the Goods existing at the time of transfer of danger to the Customer or resulting from a reason inherent in the sold Goods at the same time, consisting in the non-compliance of the Goods with the contract.
- The customer may use out-of-court methods of dealing with complaints and pursuing claims. In order to take advantage of the possibility of amicable resolution of disputes regarding online purchases, the Consumer may submit a complaint, e.g. via the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/
- When submitting a complaint, the customer may use the complaint form (click here).
- In the event of a complaint, evaminge.com recommends returning the Goods in the original packaging, with the original proof of purchase and a description of the complaint attached, to the registered office address.
- The evaminge.com store will consider complaints within 14 days from the date of receipt of the complaint.
- If the complaint is accepted, the defective goods will, in accordance with the Consumer's will, be repaired or replaced with another one of full value, and if this is no longer possible (for example due to exhaustion of stocks of the goods) or it would require excessive costs, then evaminge.com in consultation with the Customer, will refund the Customer the equivalent of the price of the Goods or reduce the price or, with the Customer's consent, offer him other goods available in the evaminge.com Store to choose from.
- If the sale is made to the Customer as part of a transaction that does not meet the definition of consumer sales within the meaning of the acts specified in section 1 above, the complaint is considered in accordance with the relevant provisions of the Civil Code. In such a case, the specific consumer protection provisions do not apply.

X WITHDRAWAL FROM THE CONTRACT
- Pursuant to Art. 27. Act of May 30, 2014 on consumer rights (Journal of Laws of June 24, 2014, item 827), a customer who is a consumer concluding a distance contract has the right to withdraw from the contract without giving reasons, within 14 days from the date of receipt of the Goods and immediately return the purchased Goods. unchanged. The declaration of withdrawal should be sent to evaminge.com at shop@evaminge.com
- A customer who wants to withdraw from the contract has the right to use the declaration of withdrawal form.
- In the event of withdrawal from the contract, the Customer shall not bear any costs, except for the costs of returning the Goods to the Store.
- The Customer is obliged to immediately, no later than within 30 days of withdrawal from the contract, return the Goods, preferably together with a copy of the declaration of withdrawal, to the address of the EYE MINGE headquarters with the note "RETURN evaminge.com".
- Exceeding the 30-day deadline for withdrawal from the contract will constitute grounds for not accepting the withdrawal from the contract.
- The price, if paid, will be refunded in the manner indicated in Chapter XI of the Regulations ("Refund to customers").
XI REFUND TO CUSTOMERS
- The evaminge.com store will immediately refund the amount due in the event of:
- evaminge.com refunds the payment using the same method of payment that the Customer used when purchasing the goods, unless the Customer has expressly agreed to a different method of return, which does not involve any costs for him.
- The evaminge.com store will refund the payment within the deadlines specified in mandatory provisions of law.
XII. PERSONAL DATA
- By placing an Order in the Online Store (at the time of acceptance of these regulations), the Customer consents to placing his or her personal data in the evaminge.com customer database and to their processing for the purposes of implementing the contract. Providing personal data by the Customer is voluntary, but the lack of consent to the processing of personal data makes it impossible to complete the Customer's order.
- Customers of the evaminge.com store and other users of the eyeminge.com website have the opportunity to voluntarily consent to receiving commercial information from the evaminge.com store within the meaning of the Act of July 18, 2002 on the provision of electronic services (Journal of Laws 02.144.1204 as amended).
- Personal data obtained via the eyeminge.com website are protected in accordance with the Act of May 10, 2018 on the protection of personal data, and in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as "GDPR", in a way that prevents access by third parties. The administrator of personal data is Eva Minge Design Sp z o. o. based in Katowice, address: al. W. Roździeńskiego 188c 40-203 Katowice, entered into the Register of Entrepreneurs of the National Court Register under KRS number 0000428080. Share capital: PLN 9,700,000.00 paid in full, REGON 242959643, NIP 9542738327. Customers have the right to inspect and amend their data personal data and their deletion. The data will be used for purposes in accordance with the consent granted by the Customer, i.e. for the execution of the Order, and in the case of consent to receive commercial information, for sending such information.
- Scope of processed personal data:
- If the Customer chooses to pay via the system:
- After the Customer has selected the Goods that he wants to purchase via the evaminge.com Online Store, the IT system operating the Online Store will present the Customer with information on the protection of personal data in accordance with Annex No. 1 to these Regulations, as well as the content of these Regulations. If the Customer accepts the content of these Regulations and consents to the processing of his personal data for the purposes of the Goods ordering process, then the Customer selects (by clicking) the first and second square of the "evaminge.com Online Store Customer's declaration" form with the content indicated in the attachment number 1 to these Regulations. Checking both of the above boxes is voluntary, and failure to accept the Regulations or failure to consent to the processing of personal data is treated as resignation from the placed order (no sales contract is concluded or the order is not processed). Only after the Customer has selected the acceptance form of the Regulations and the form of consent to the processing of personal data - the system operating the Online Store will ask the Customer to provide personal data necessary to conclude a sales contract and complete the order. The customer also has the option of checking the third box (consent to receiving commercial information electronically), however, checking this consent is voluntary, and failure to check this box does not prevent the order from being processed.
- The Customer also has the option of creating a Customer Account, i.e. providing the Customer's personal data, which will be automatically saved in the evaminge.com IT system, along with data on previous transactions and the status of the currently placed order. Access to the Customer Account is protected by the login and password created by the Customer during the registration process. Creating a Customer Account does not require completing the Customer's data each time you try to place an order (the system will automatically download the Customer's data saved in the Customer Account), but it does require providing the Customer's data, which will be saved in the evaminge.com IT system. Providing data for creating a Customer Account is voluntary, and creating a Customer Account is possible only after the Customer accepts (electronically) the first and second squares of the "evaminge.com Online Store Customer's declaration" form with the content indicated in Annex 1 to these Regulations. Checking both of the above boxes is voluntary, and failure to accept the Regulations or failure to consent to the processing of personal data is treated as resignation from creating a Customer Account. Only after the Customer has selected the acceptance form of the Regulations and the form of consent to the processing of personal data - the system operating the Online Store will allow the creation of a Customer Account. The Customer also has the option of checking the third box (consent to receiving commercial information electronically), however, checking this consent is voluntary, and failure to check this box does not prevent the registration of the Customer Account.
- Rights of data subjects. Pursuant to the GDPR, you have the right to:
XIII. FINAL PROVISIONS
- The sales contract is concluded between the Customer and evaminge.com in Polish and is subject to Polish law. The essential provisions of the concluded contract are recorded, secured and made available by providing the customer with the acceptance of the order in the form of an e-mail and a VAT invoice sent with the Goods, which contains all the elements required by tax regulations, including the details of the seller and the buyer, the Goods, price, quantity purchased Goods. Acceptance of these regulations by the Customer who is also a consumer is tantamount to submitting a request to issue an invoice documenting the sale.
- To use the Store's services, the Customer is obliged to have access to the Internet and use the devices and software necessary to display websites.
- These Regulations do not limit the rights granted to consumers by the legislation in force in the Republic of Poland.
- All rights to photos and video materials posted on the eyeminge.com website belong to evaminge.com. It is prohibited to use them in any field of exploitation.
