PERSONAL DATA

1.      This policy contains basic information regarding the processing of personal data by the Administrator in the online store, including the purposes and legal basis for personal data processing, the data processing period and information on the rights of data subjects.

2.      The personal data controller is Eva Minge Design Sp z o. o. with its registered office in Katowice, address:ul. Bażantów 35, 40-668 Katowice, entered into the Register of Entrepreneurs of the National Court Register under KRS number 0000428080. 3.      Personal data obtained via the eyeminge.com website are processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as "GDPR", and in accordance with the Personal Data Protection Act of 10 May 2018.

4.      Customers of the evaminge.com store and other users of the eyeminge.com website have the opportunity to voluntarily consent to receiving commercial information from the evaminge.com Store within the meaning of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws 02.144.1204, as amended).

5.      By placing an order in the Online Store (upon accepting these terms and conditions), the Customer consents to the inclusion of their personal data in the evaminge.com customer database and to their processing for the purposes of fulfilling the contract. Providing personal data by the Customer is voluntary, but without providing and processing the data, we will not be able to fulfill the order.

6.      When making a purchase on our website, the Customer is required to provide the following personal data:

o   First name and last name

o   Email addresses

o   Delivery address

o   Phone number

o   Additionally, if an invoice needs to be issued, it is necessary to provide the Tax Identification Number and the buyer's address, if it is different from the delivery address.

7.      In each case, the purpose, legal basis, and period of personal data processing result from the actions taken by the Customer of our store or the Administrator. The purposes, legal basis, and periods of data storage are indicated in the table below.

Bookkeeping. Article 6 paragraph 1 letter c of the GDPR in connection with Article 74 paragraph 2 of the Accounting Act of 30 January 2018 (Journal of Laws of 2018, item 395). Processing is necessary to fulfil the legal obligation to which the Controller is subject. The data is stored for the period required by law requiring the Controller to store accounting books (5 years, counted from the beginning of the year following the financial year to which the data relate).
Establishing, pursuing or defending claims. Article 6(1)(f) of the GDPR Processing is necessary for the purposes of the Controller's legitimate interests in establishing, pursuing or defending legal claims. The data is stored for the duration of the legitimate interest pursued by the Controller, but no longer than the limitation period for claims that may be brought against the Controller (the basic limitation period for claims against the Controller is six years).
Marketing (newsletter sending). Article 6(1)(a) of the GDPR Consent expressed by the data subject regarding the processing of his or her data for marketing purposes. The data is stored until the data subject withdraws consent to further processing of his or her data for this purpose.
Customer profiling Article 6(1)(f) of the GDPR Processing is necessary for the purposes of the Controller's legitimate interests in better tailoring the offer to a given customer through profiling. The data is stored for the duration of the legitimate interest pursued by the Controller or until an effective objection to processing is raised.
Using the Online Store website and ensuring its proper functioning. Article 6 paragraph 1 letter f of the GDPR Processing is necessary for the purposes of the legitimate interests of the Controller consisting in operating and maintaining the Online Store website. The data is stored for the duration of the legitimate interest pursued by the Controller or until an effective objection to processing is raised.
Maintaining statistics and analyzing traffic in the Online Store in order to optimize the operation of the website. Art. 6 section 1 letter f GDPR Processing is necessary for the purposes of the legitimate interests of the Controller consisting in maintaining statistics and analysing traffic in the Online Store in order to improve the functioning of the Online Store and increase sales of Products. The data is stored for the duration of the legitimate interest pursued by the Controller or until an effective objection to processing is raised.

 

 

8.      To ensure the proper functioning of the online store and the proper provision of services to its customers, the Administrator may utilize the services of external entities, such as courier companies, software providers, companies providing technical support for the store, hosting and IT service providers, payment processors, and companies supporting the Administrator in marketing campaigns. The Administrator only utilizes the services of entities that provide sufficient guarantees that the data entrusted to them will be processed solely on the Administrator's instructions, in accordance with its guidelines, and in compliance with the provisions of the GDPR.

9.      The Administrator may use profiling in the Online Store for direct marketing purposes, but the decisions made based on it by the Administrator do not concern the conclusion or refusal to conclude a Sales Agreement. The use of profiling in the online store may result in, for example, reminders about unfinished purchases, sending product suggestions that may suit a given individual's interests or preferences, or offering better terms compared to the standard online store offer. Profiling in the online store involves the automatic analysis of a given individual's behavior on the store's website or by analyzing previous purchase history and suggesting adding a specific product to the cart or offering an additional discount. The condition for such profiling is that the Administrator has the individual's personal data so that it can then send them, for example, a discount code.

10.   Every user of the online store has the following rights related to the processing of their personal data:

o   The right to access your personal data, rectify it, delete it, limit its processing, as well as to object to its processing and the right to transfer data

o   If processing is based on consent, the person has the right to withdraw consent at any time

o   The right to lodge a complaint with the supervisory authority, which is the President of the Personal Data Protection Office.
